Care Proceedings and Child Protection

Social Services have a duty under the Children Act to protect vulnerable children and if any report is made to them that a child has suffered harm or is likely to suffer harm that is significant they are duty bound to investigate and, if they consider appropriate, will start what are termed Care Proceedings.

This can be a very frightening process for parents who may well be deeply upset by any injury their child may have suffered or who may dispute the allegations made about the safety or welfare of their child. We can help in many ways.

For the children involved we may be appointed by the Court to represent the interests of children in Care Proceedings.

For parents - We represent parents who are involved in Care Proceedings. In our role as legal advisors to you as parents, we will:

• Attend every important meeting with you.
• Represent you at any hearings.
• Guide you through what can be a traumatic process.

If at all possible the Court will want to work to reuniting a child with his or her family provided any concerns can be addressed and the child can return in safety. If you are subject to an investigation by Social Services please do not delay obtaining legal advice.
