We receive a significant number of enquiries every year from people looking to change either their own or their child’s name. We are pleased to announce that we can now offer a fixed fee to assist people with changing their name or wanting to change the name of a child.
How is a change of name done?
When looking to change a name, people are often directed towards what is known as an ‘enrolled’ change of name deed, and the the completion of ‘LOC’ forms. These require proof of your nationality, permission from any spouse and a witness who has known you for at least 10 years to your change of name. Notice will also need to be given to the Gazette which will make your change of name a matter of public record.
The alternative option is that of an unenrolled Deed Poll which, unlike the enrolled option, won’t require you to send anything to the Court or the Gazette. Rather than various forms to complete, an unenrolled Deed Poll is one document which is often drafted by a solicitor/professional. The unenrolled Deed Poll can be far easier and faster way to complete a change of name. If people are seeking to change their name on an unenrolled basis, this is where we can usually offer our new fixed fee.
Is there a disadvantage to an unenrolled Deed Poll?
People often think as a result that an unenrolled deed poll is worth less than an enrolled Deed Poll, or is not going to be accepted with organisations such as the Passport Office or DVLA. This is not the case though, having been addressed in the case of D v B in 1979 where, at the Court of Appeal, Lord Justice Ormrod stated that “A deed poll is just as effective or ineffective whether it is enrolled or not”.
Enrolment is not necessary for the vast majority of individuals, and usually tends to only be required for those with significant links to other countries such as the United States.
Change of Name for a Child
The change of name for a child is also done through a Deed Poll but there can be additional consideration(s) for these. The main consideration for this will be whom has parental responsibility for that child and whether they are in agreement with the change of name.
